1. Status of this document
These terms are published in template form for transparency and review. They are not an executed agreement, they are not legal advice, and they do not yet reflect the requirements of any particular jurisdiction. The contracting entity, its address and the effective date are [to be completed on legal review].
2. What the service is
AnswerRank measures how brands appear in AI answer surfaces. It does so by executing prompts against web-grounded provider APIs and by observing licensed structured search-results data, then analysing and scoring the results.
It does not replicate a signed-in consumer chat session and does not scrape authenticated consumer interfaces. The scope and limits of the measurement are described on the methodology page, which forms part of how these terms should be read.
3. Accounts and workspaces
You are responsible for the accuracy of your account details, for keeping your credentials secure, and for the actions taken by users you invite into your organisation. Roles carry different privileges, and granting someone an administrative role is a decision with consequences inside your workspace.
4. Plans, checks and billing
The billing unit is a check: one prompt executed against one engine for one market. Plans differ in the number of brands and checks they include and in which capabilities are enabled. Prices and inclusions are those displayed at the time of purchase.
Subscriptions are billed in advance through our payment provider and renew until cancelled. Taxes, refund handling, proration on plan changes and cancellation mechanics are [to be completed on legal review].
5. Acceptable use
- Do not use the service to break the law or to infringe anyone’s rights.
- Do not attempt to circumvent plan limits, rate limits or access controls, and do not probe another organisation’s data.
- Do not put credentials, confidential information or personal data about identifiable individuals into tracked prompts. Prompts are transmitted to third-party answer engines by design.
- Do not resell or redistribute raw measurement output as a competing dataset. Using reports with your own clients is expected on plans that include client workspaces.
- Do not use the service to generate content designed to mislead about who is behind it.
6. Your data and our platform
You keep ownership of what you put into AnswerRank: your brands, prompts, settings and any content you upload. We keep ownership of the platform itself — the software, models of analysis, interface and documentation.
Reports and measurement outputs produced for your workspace are yours to use commercially. We may use aggregated, de-identified statistics that cannot reasonably be linked back to you or your customers to operate and improve the service.
7. Third-party answer engines
The answers we measure are produced by third parties. Their models, retrieval behaviour, availability, pricing and terms are theirs to change, and they change often. An engine may become unavailable, change its output style, or restrict programmatic access with no notice to us.
We are not affiliated with, endorsed by, or acting as an agent of any answer engine provider. Their names are used only to identify the surface being measured.
8. Limits of measurement
AI answers are non-deterministic and sampled. AnswerRank reports what it observed, with the sample size and collection method attached. It reports association rather than causation, and it does not promise any particular visibility, ranking, traffic or commercial outcome.
Recommendations produced by the product are informed suggestions for you to evaluate, not instructions and not professional advice.
9. Availability and changes
We do not currently publish an uptime commitment or a support response time, and we would rather say that than publish one we have not staffed. Any service level commitment would be [to be agreed in a separate service level addendum]. We may change or discontinue features, and will give notice of materially adverse changes to paying customers.
10. Suspension and termination
You may cancel at any time. We may suspend or terminate access for non-payment, for a breach of the acceptable use section, or where we are required to by law. On termination we will make your data available for export for a reasonable period, then delete it in line with our retention practice. The export window is [to be confirmed].
11. Disclaimers
To the maximum extent permitted by applicable law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow such exclusions, in which case they apply only to the extent permitted.
12. Limitation of liability
To the maximum extent permitted by applicable law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our aggregate liability is capped at [cap to be set on legal review — commonly fees paid in the preceding 12 months]. Nothing here excludes liability that cannot lawfully be excluded.
13. Governing law
Governing law, venue and dispute resolution are [jurisdiction to be selected on legal review]. Consumer protection rights that apply in your country of residence are not affected by that choice.
14. Changes and contact
We will post updates to this page and notify account holders of material changes. Because this version is a template, it should be expected to change substantially once reviewed. Questions go to hello@answerrank.io.
Reminder: this is an unexecuted template published for review. It is not legal advice and does not create obligations until it has been reviewed, completed and adopted.
